1. Acceptance of Terms

By accessing, browsing, downloading, or using CONDOIMAGE (“Platform”), you agree to be legally bound by these Terms of Use. Electronic acceptance constitutes a binding agreement. If you do not agree, discontinue use immediately.

2. Independent Platform Status

CONDOIMAGE is an independent visual media and information platform.

CONDOIMAGE is not affiliated with, endorsed by, sponsored by, or officially connected to any developer, builder, HOA, condominium association, property management company, brokerage, governmental entity, or real estate professional unless expressly stated in writing.

The appearance of any building or development does not imply partnership, endorsement, authorization, approval, or agency.

CONDOIMAGE is not a real estate broker, agent, financial advisor, or legal advisor. All content is for informational purposes only.

3. Copyright & Intellectual Property

3.1 Platform Intellectual Property

Except for Developer Materials (Section 4.2), all content on the Platform — including photographs, videos, text, building descriptions, database structure, compilations, layout, design, logos, trademarks, software, and code — is owned by CONDOIMAGE or its licensors. The compilation, organization, and arrangement of content constitutes proprietary intellectual property of CONDOIMAGE.

Unauthorized scraping, mirroring, framing, database extraction, reverse engineering, republication, or automated harvesting is strictly prohibited.

3.2 Trademarks

“CONDOIMAGE” and related branding elements are trademarks of CONDOIMAGE. No license to use trademarks is granted without prior written consent.

4. Ownership of Content

4.1 CONDOIMAGE-Owned Content (Paid Licensed Content)

All original photography, drone footage, video, and related visual media (“Owned Content”) are the exclusive property of CONDOIMAGE or its licensors. Access to Owned Content may require payment. No ownership rights are transferred.

4.2 Developer Materials (Public Access Content)

Renderings, floor plans, brochures, and promotional visuals (“Developer Materials”) remain the property of their respective developers or rights holders.

CONDOIMAGE:

• Does not claim ownership
• Does not sell or sublicense
• Does not charge for access
• Excludes Developer Materials from API feeds

Subscription fees apply only to Owned Content. Developer Materials are displayed for informational purposes and may be removed at any time.

5. License Grant – Owned Content

CONDOIMAGE grants a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to use Owned Content solely for marketing a specific real estate listing.

Permitted uses include: MLS listings, property websites, social media, print marketing, digital advertising, and MLS syndication. Use is worldwide for lawful marketing purposes. All rights not expressly granted are reserved.

6. Listing-Specific Restriction

Owned Content is tied to the licensed user, the specific property listing, and the active marketing period. Owned Content may not be reused for other listings or transferred to other agents.

Upon sale or expiration, active advertising and paid promotion must cease. Archival, non-promotional portfolio use is permitted.

7. Payment & Billing Terms

Fees for access to Owned Content are non-refundable once content is downloaded or accessed. CONDOIMAGE may suspend access for non-payment or chargebacks. Users are responsible for applicable taxes. CONDOIMAGE reserves the right to modify pricing at any time.

8. Account Access & Termination

User accounts are non-transferable. CONDOIMAGE may suspend or terminate access at its sole discretion for violations, misuse, fraud, scraping, or infringement.

9. No Implied License

No implied license is granted. All rights not expressly granted are reserved.

10. User Responsibility & Indemnification

Users are responsible for lawful use of all content. Users agree to indemnify, defend, and hold harmless CONDOIMAGE from claims arising from user misuse, redistribution, copyright violations, or breach of these Terms.

11. Prohibited Uses

Users may not:

• Resell or sublicense Owned Content
• Create competing libraries
• Use content to train AI models
• Remove metadata
• Reverse engineer
• Scrape or harvest data
• Circumvent safeguards

12. DMCA Safe Harbor

CONDOIMAGE qualifies as a service provider under 17 U.S.C. §512 and maintains a repeat infringer policy. Valid DMCA notices must include required statutory elements. CONDOIMAGE will promptly remove infringing content upon proper notice.

13. Disclaimer of Accuracy

All content is provided “as is.” CONDOIMAGE does not guarantee accuracy, completeness, or investment suitability. Users rely on content at their own risk.

14. Limitation of Liability

To the maximum extent permitted by law, CONDOIMAGE shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits. Total liability shall not exceed the amount paid for the applicable license.

Images, Renderings, and Other Assets. CONDOIMAGE shall have no liability or responsibility with respect to images, renderings, videos, floor plans, or any other assets or content displayed on the Platform that are outside CONDOIMAGE’s control, and CONDOIMAGE is released and held harmless from any claim, loss, or problem arising from such materials. Where images or other content appear on the Platform as a result of a third party, any legal matter relating to that material must be directed to the third party that supplied or placed it. Any person seeking legal compensation in connection with such third-party images, project renderings, or other assets shall indemnify and hold CONDOIMAGE and its affiliates harmless from and against any and all losses, liabilities, claims, charges, actions, proceedings, demands, judgments, settlements, costs, and expenses (including, without limitation, fees and expenses of counsel) that CONDOIMAGE or its affiliates may incur as a result of or arising in any way from the use of such images, project renderings, or other assets.

15. Arbitration & Class Action Waiver

All disputes shall be resolved by binding arbitration in Miami-Dade County, Florida under the Federal Arbitration Act. Users waive jury trial and class action rights. Claims must be brought individually. Small claims court is permitted where applicable.

16. Force Majeure

CONDOIMAGE shall not be liable for delays or failures due to causes beyond reasonable control.

17. Assignment

Users may not assign rights under these Terms without written consent. CONDOIMAGE may assign these Terms in connection with merger, acquisition, or asset sale.

18. Privacy Policy

Use of the Platform is also governed by the CONDOIMAGE Privacy Policy, incorporated by reference.

19. Feedback

Users grant CONDOIMAGE a perpetual, royalty-free license to use feedback, suggestions, or ideas without compensation.

20. Modification of Terms

CONDOIMAGE may modify these Terms at any time. Continued use constitutes acceptance.

21. Entire Agreement

These Terms constitute the entire agreement between the parties.

22. Severability

If any provision is unenforceable, remaining provisions remain in effect.

23. Governing Law

These Terms are governed by Florida law, without regard to conflict of law principles. Arbitration and venue shall be Miami-Dade County, Florida.
