Copyright Concerns & DMCA Notice

CondoImage respects the intellectual property rights of photographers, developers, architects, designers, media companies, and other copyright owners.

CondoImage displays and distributes different types of real estate media. Certain media is owned by CondoImage, while other materials—including developer renderings, floor plans, brochures, and promotional materials—may be owned by developers or other third-party rights holders.

If you believe material available through CondoImage infringes a copyright that you own or are authorized to enforce, you may submit a copyright infringement notification under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.

Content Updates, Corrections & Removal Requests

You do not need to file a formal DMCA notice simply to request an update, correction, attribution change, replacement, or removal of content.

If you are a developer, authorized marketing representative, photographer, architect, or other rights holder and simply want us to update, correct, replace, properly attribute, or remove material, you may contact CondoImage directly without filing a formal DMCA notice.

We aim to resolve legitimate content-rights concerns promptly.

DMCA Copyright Infringement Notice

To submit a formal DMCA notification, please provide a written notice containing substantially the following information:

  1. Identification of the copyrighted work you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of those works.
  2. Identification of the material you claim is infringing and information reasonably sufficient to allow CondoImage to locate the material, preferably including the specific CondoImage page URL and, when available, the image or media URL.
  3. Your name and contact information, including your mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or applicable law.
  5. A statement that the information in your notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

What Happens After We Receive a Notice

Upon receiving a valid copyright infringement notification, CondoImage may investigate the claim and remove or disable access to the identified material when appropriate.

Where applicable, CondoImage may notify the party that provided the affected material and provide information regarding the DMCA counter-notification process.

CondoImage reserves the right to remove or restrict access to content when we reasonably believe doing so is necessary to address copyright concerns, protect rights holders, comply with applicable law, or protect the integrity of the CondoImage platform.

DMCA Counter-Notification

If material you provided to CondoImage has been removed or disabled as a result of a DMCA notification and you believe the material was removed because of mistake or misidentification, you may submit a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement consenting to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. § 512(g), and that you will accept service of process from the person who submitted the original DMCA notification or that person's agent.

Counter-notifications may be submitted through the same Copyright & DMCA contact channel above.

Where permitted by law, CondoImage may restore affected material following receipt of a valid counter-notification unless the original complaining party provides notice that it has filed an action seeking a court order regarding the material.

Misrepresentations

Knowingly making material misrepresentations in a DMCA notification or counter-notification may result in liability under applicable law.

Repeat Infringers

Where appropriate and in accordance with applicable law, CondoImage maintains a policy providing for the termination or restriction of users or contributors who are determined to be repeat infringers.

Independent Platform

CondoImage is an independent real estate media and information platform. The appearance of a building, development, rendering, floor plan, photograph, or other media on CondoImage does not by itself imply affiliation with, endorsement by, or authorization from the applicable developer, condominium association, property manager, brokerage, photographer, or other rights holder.
